REAL ESTATE AGENT
If you are using a real estate agent, you need to nominate one and sign an agency agreement.  You then need to contact us to provide instructions and details as to the property you wish to sell.  We will then send the contract to your agent so they can commence marketing the property as it is illegal to market residential property without a contract. If you are not using a real estate agent, we will send you the contract directly once prepared to enable you to commence marketing the property. 

OPTIONAL REPORTS / CERTIFICATES
If you are selling by way of auction you may like to consider arranging a pest and building report to be available for purchase by prospective purchasers.  The successful purchaser ultimately pays for the reports.If you have a survey report or building certificate or any plans or certificates relating to the property attaching them to the contract can be a helpful marketing tool.

CONTRACT
We need to prepare a contract.  The following points outline some of the information we need from you for the contract:

1) If you have undertaken work to the property, we will need the details including any approvals or insurance certificates relating to the work.  If you have undertaken work as an owner builder we also need to disclose this in the contract.

2) If you have a pool you will need to provide us with the Council registration certificate evidencing registration and a Pool Compliance Certificate or Non-Compliance Certificate.  I can assist by providing contact names for pool inspectors to obtain a Certificate of Compliance if required.

CERTIFICATE OF TITLE
If you do not have a mortgage over the property you will need to locate and provide the original Certificate of Title to us to hand over at settlement of the sale. If you have a mortgage, your mortgagee will provide the Certificate of Title to us at settlement.  We will arrange for a discharge of your mortgage once you find a purchaser.

PASSING OF RISK
You must take care of the property between exchange of contracts and settlement including mowing lawns, pool care etc.   It is strongly recommended that you keep your house and contents insurance in place until the day of settlement as normally the risk does not pass to the purchaser until settlement so you are responsible for the property up until settlement.

 

NOTIFYING SERVICE PROVIDERS AND AUTHORITIES OF CHANGE OF OWNERSHIP
At settlement we will arrange for the purchaser to pay you directly for their share of Council and Water rates and/or the strata levies and any actual outstanding amounts will be paid out of settlement funds.  Either your mortgagee or, if none then our office will then attend to notifying Council and the water board and/ or the strata manager of the change of ownership.  All personal services including electricity, phones, insurance will be your responsibility to change over/cancel.

COSTS
When selling you should budget for the following general costs:

  • Payout of any mortgage over the property or linked to the property;

  • If you are breaking a fixed mortgage – any break costs;

  • Our fee;

  • The commission payable to the agent;

  • Outstanding rates, levies and land tax; and

  • Removalist fees.
